ATF Announces New Era of Reform for Gun Regulations

ATF Launches “New Era of Reform”: Director Robert Cekada Signs Landmark 34-Rule Package to Slash Gun Regulation Burdens
Two days ago, on April 29, 2026, the U.S. Senate confirmed longtime ATF veteran Robert Cekada as Director in a bipartisan 59-39 vote. Hours later, in his first official act, Director Cekada joined Acting Attorney General Todd Blanche to sign 34 notices of proposed and final rulemaking—the most comprehensive regulatory overhaul in ATF history.
Dubbed the “New Era of Reform” and driven by President Trump’s Executive Order 14206 (“Protecting Second Amendment Rights”), the package repeals Biden-era overreaches, modernizes outdated processes, reduces paperwork, clarifies ambiguities, and aligns rules with current law, Supreme Court precedent, and agency practice.
The goal, per officials: Focus enforcement on “willful violators and criminal actors, not inadvertent compliance issues by responsible owners and licensees.” Summaries are posted at ATF.gov, with most proposed rules open for public comment.
The 34 Changes, Grouped by Category
Repeal (4 rules) – Scrapping Failed or Unlawful Regulations
- Stabilizing Braces Rule (1140-AA98, NPRM): Fully rescinds 2023 rule reclassifying braced pistols as short-barreled rifles; restores prior definitions after court injunctions.
- “Engaged in the Business” Rule (1140-AB01, NPRM): Rolls back expanded dealer licensing definition; keeps only statutory changes from Bipartisan Safer Communities Act.
- Machine Gun / Bump Stock Rule (1140-AA60, Final Rule): Removes bump-stock language from machine-gun definition to match Supreme Court Garland v. Cargill (2024).
- Youth Handgun Safety Act Posting Requirement (1140-A87, NPRM): Eliminates mandatory signs and notices for handgun buyers—rule in place 30+ years, now unnecessary.
Modernize (5 rules) – Bringing Forms, Records, and Processes into the 21st Century
- Form 4473 Updates (1140-AA82, NPRM): Streamlines ID verification, extends NICS check validity, allows electronic forms/notices.
- Electronic Recordkeeping (1140-AA94, NPRM): Authorizes digital A&D books and 4473 storage for FFLs.
- Records Retention Periods (1140-AA95, NPRM): Sets 20-30 year limits (instead of indefinite); shorter for some records.
- eZ Check License Verification (1140-AA61, Direct Final Rule): Lets FFLs use ATF’s online system instead of paper copies.
- Non-Over-the-Counter Sales (1140-AB05, NPRM): Eases same-state resident transfer verification while keeping Brady checks.
Reduce Burden (7 rules) – Cutting Red Tape on NFA and Transport
- Interstate/Temporary NFA Transport (NPRM): No advance approval for short-term moves; notice only for long-term.
- Spousal Joint NFA Registration (NPRM): Allows married couples to register NFA items jointly without a trust.
- CLEO Notification for NFA (NPRM): Eliminates requirement to notify local police chiefs.
- Interstate Firearm Transport (NPRM): Clarifies travel stops and rules for ammo/accessories.
- Machine Gun Transfers Between Licensees (NPRM): Simplifies demo/discontinuation transfers.
- Special Occupational Tax per Activity (NPRM): One SOT fee per business activity/location.
- Plastic Explosives Import Filing (Final Rule): Drops triplicate paperwork.
Clarify (12 rules) – Eliminating Ambiguity for Law-Abiding Owners & Businesses
- Foreign Trade Zones / Bonded Warehouses importation definition and activities.
- Dual-use frames/receivers/barrels import rules.
- Training rounds (inert) not classified as ammunition.
- Temporary-to-permanent import conversion process.
- NFA maker markings adoption.
- Carrier delivery during personal transport.
- Updated mental health prohibition definitions.
- Brady Act state-permit exceptions.
- Biological sex on ATF forms (per EO).
- Expanded “business premises” definition.
- Straw purchase guidance.
- New “willfully” violation standard (Supreme Court alignment).
Align (6 rules) – Technical Fixes with Statute, Courts & Other Agencies
- NFA making application NICS check codification (Final).
- Export control conforming amendments.
- Dynamic proscribed countries list for imports.
- Arms Export Control Act component definitions.
- PATRIOT Act contraband tobacco updates (Final).
- NFA tax remittance statutory alignment (Final).
What This Actually Means for Gun Owners
This isn’t just bureaucratic housekeeping—it’s a massive Second Amendment victory. For years, the ATF under the prior administration treated lawful gun owners and FFLs as suspects, layering on vague, ever-expanding rules designed to harass rather than enforce. Director Cekada’s package flips the script: it repeals the worst offenders (braces, bump stocks, “engaged in the business”), kills indefinite record-keeping that turned every FFL into a permanent government archive, and removes pointless hurdles like CLEO sign-offs and triplicate forms.
The practical impact?
- More freedom, less fear: Millions of braced pistol owners can breathe easy. Casual sellers and hobbyists won’t be forced into dealer licenses. NFA owners get simpler trusts, transport, and spousal transfers.
- Real compliance, not gotcha enforcement: “Willful” now means knowingly breaking the law—not a paperwork typo. Electronic records and online checks modernize an agency stuck in the fax-machine era.
- Constitutional alignment: Every change explicitly cites Supreme Court rulings, statutory text, and court losses the prior rules suffered. This is the executive branch finally admitting the Second Amendment isn’t a “second-class right.”
Critics will cry “dangerous deregulation,” but the data shows violent crime is driven by criminals, not law-abiding owners navigating 4473s. ATF’s new mission—target willful violators—actually makes communities safer while respecting the rights of the 99.9% who follow the law.
This package proves that when leadership prioritizes the Constitution over politics, the right regulatory balance is possible: enforce the law against bad actors, get out of the way of everyone else. For gun owners, this is the first major federal rollback in decades. Expect more as comments roll in and final rules drop. The Second Amendment just got a lot more breathing room.
